C.M. Recommendation:    Approve as recommended in the staff report.

Approval of a License Agreement between The County Board of Arlington County, Virginia, as Licensor, and Legal Services of Northern Virginia, Inc., as Licensee, for use of 142 square feet of office space in the Arlington County Courthouse building, Room 11C01, located at 1425 North Courthouse Road, Arlington, Virginia (RPC#: 17015011).



C.M. Recommendation:    Approve the License Agreement (attached to the staff report) between the County Board and Legal Services of Northern Virginia, Inc. for the use of Room 11C01 located in the Arlington County Courthouse building at 1425 North Courthouse Road, Arlington, Virginia, RPC #17015011.  In addition, authorize the Real Estate Bureau Chief, or his designee, to execute, on behalf of the County Board, the License Agreement, and all related documents, subject to approval as to form by the County Attorney.

C.M. 13. Amendment to the ordinance on precincts and polling places.



C.M. Recommendation:    Approve the advertised proposed amendment to the ordinance on precincts and polling places to move the polling place for the Overlee Knolls Precinct 017 from the Resurrection Lutheran Church, 6201 Washington Boulevard, back to its permanent location at Walter Reed School, 1644 North McKinley Road.

14. ZOA-09-10A Zoning Ordinance amendment to Section 31A, Subsection E12. This amendment alters the standard for County Board review of appeals of Historical Affairs and Landmark Review Board (HALRB) decisions.



C.M. Recommendation:    Defer the ordinance (ZOA-09-10A attached to the staff report) to amend, reenact and recodify Section 31A of the Zoning Ordinance to change the standard by which the County Board would review appeals of decisions from the HALRB to the March 13, 2010, County Board meeting.

16. Allocation of Fiscal Year (FY) 2010 Affordable Housing Investment Fund (AHIF) funds as a loan to the Arlington Partnership for Affordable Housing (APAH) to assist with the rehabilitation of Buchanan Gardens Apartments.



C.M. Recommendation:    Allocate up to $4,332,000 in FY 2010 AHIF funds (101.495130.91102) to the Arlington Partnership for Affordable Housing (APAH) Inc., or its designated County-approved ownership affiliate, to assist with the rehabilitation of Buchanan Gardens Apartments. The financing assistance is in the form of a subordinated, residual receipts loan, subject to the terms and conditions outlined in this report.  Authorize the County Manager to execute the required documents for a loan for up to $4,332,000 to APAH or its designated County-approved ownership affiliate, subject to the terms and conditions outlined in the report and authorize and direct the trustees for the County’s Deed of Trust to execute the required loan and subordination documents subject to approval by the County Attorney.  In addition, authorize the County Manager, with the concurrence of the County Attorney, to act as the County Board’s representative in approving financing or program revisions that are necessary to remove any ambiguity or inconsistency or which improve the County’s financial security or financial position, and which changes do not adversely affect the County financially, prior to or after execution of the County’s financing documents.

17. Authorizations to file FY 2011 Commuter Services Program grant applications.



C.M. Recommendation:    Adopt the resolution (attached to the staff report as Attachment 1) authorizing the County Manager to execute and file an application to the Virginia Department of Rail and Public Transportation ("DRPT") totaling $1,875,000 from the Transportation Demand Management /Commuter Assistance Projects Grant Program.  In addition, adopt the Resolution (attached to the staff report as Attachment 2) authorizing the County Manager to execute and file an application to DRPT totaling $1,550,000 from the Transportation Efficiency Improvement Fund Program.

18. Request to advertise for a public hearing for proposed amendments to the County’s Motor Vehicle Code, Chapter 14.2, Article 1 of the Arlington County Code.



C.M. Recommendation:    Authorize the request to advertise a public hearing to be held March 13, 2010, to consider proposed amendments to the County’s Motor Vehicle Code, Chapter 14.2, Article 1 of the Arlington County Code concerning the use of emerging technologies for payment of parking meters.

20. Consideration of the conversion and re-subordination of loans to three (3) AHC Inc. multifamily residential properties to new ownership entities to facilitate the planned renovations of Ashton House, Key Gardens, Taylor Square Apartments and North Ashton.



C.M. Recommendation:    Approve the consolidation of the existing Affordable Housing Investment Fund (AHIF) and Community Development Block Grant loans and deeds of trust on the Ashton House, Key Garden, and Taylor Square Apartments to new first deeds of trust covering the same properties plus North Ashton under new ownership affiliates as detailed in the staff report and subordinate the County loans to new primary loans in the aggregate amount of up to $9.0 million.  Authorize the County Manager to approve the new ownership affiliates and to execute, subject to approval by the County Attorney, replacement AHIF and CDBG loan Agreements and deeds of subordination, which will subordinate the County’s existing loans for the Ashton House, Key Garden and Taylor Square Apartments to new first deeds of trust as detailed in the staff report and subject to the conditions set forth in the report and to amend or execute other related contract and loan documents, subject to approval by the County Attorney.  In addition, authorize the County’s Manager, with the concurrence of the County Attorney, to act as the County’s representative in approving financing and revisions that are described in this report or are necessary to remove any ambiguity or inconsistency or which improves the County’s financial security or financial position, and which changes do not adversely affect the County financially prior to execution of the County’s financing documents.

F. Request to advertise a public hearing on the proposed Fiscal Year 2011 water/sewer rate increase.



C.M. Recommendation:    Authorize advertisement of a public hearing on the proposed amendment to Chapter 26, Article 1 of the Arlington County Code (Utilities Ordinance) and authorize the advertisement for a public hearing to be held on March 25, 2010, for proposed rate increases in the water sewer services.  This proposed amendment would increase the water rate by no more than $0.08, from $3.42 to $3.50 per thousand gallons and the sewer rate by no more than $0.46, from $7.78 to $8.24 per thousand gallons.

G. Request to advertise a public hearing on the proposed Fiscal Year 2011 Infrastructure Availability Fee (IAF) increase.



C.M. Recommendation:    Authorize advertisement of a public hearing on the proposed amendment to Chapter 26, Article 1 of the Arlington County Code (Utilities Ordinance - Attachment A) and authorize the advertisement for a public hearing to be held on March 25, 2010, for proposed Infrastructure Availability Fee increases.  This proposed amendment would increase the IAF from $69 to $72 per drainage fixture unit (DFU) for water service, and from $95 to $110 per DFU for sewer service.

H. Request to advertise a public hearing for a proposed FY 2011 household solid waste rate increase.



C.M. Recommendation:    Authorize the advertisement of a public hearing on the proposed amendment to Chapter 10, Article 1 (Refuse) of the Code of Arlington County, Virginia, to be held on March 25, 2010.  The amendment, if approved, would increase the annual household solid waste rate from $325.68 to a maximum of $344.24.

I. Request to advertise a public hearing on a proposed schedule of zoning fees for Fiscal Year 2011 that would implement a 1.0% inflationary increase over Fiscal Year 2010 fees.

Recommendation Adopt the resolution (attached to the staff report) to authorize advertisement of a public hearing by the County Board on March 25, 2010, on a schedule of zoning fees for Fiscal Year (FY) 2011 that would implement a 1.0% inflationary increase over the Fiscal Year 2010 fees, in order to provide for efficient administration of the County’s review process; to encourage economic development; and to promote the health, safety, and general welfare of the public.

Recommendation:    Advertise for a March 25, 2010, public hearing on a proposed amendment to Chapter 26 of the Code of Arlington County, Virginia, to impose an increase to the sanitary district tax rate of $0.003 of assessed real property value.  This would bring the sanitary district tax rate to $0.013 per $100 of assessed real property value. County Board meetings, usually conducted once a month on Saturday mornings with a corresponding recessed meeting on Tuesday evenings within a week or two of the initial regular meeting, are open to the public. For more information, or to obtain the meeting schedule, please call the County Board Office at 703-228-3130 (TTY 703-228-4611) on weekdays from 8 a.m. to 5 p.m.
 
Both Sign Language and Spanish Language interpreters are present for the first two hours of every regular Saturday Board meeting, from 8:30 a.m. to 10:30 a.m. Persons needing interpretation services are encouraged to call the Clerk at least 3 days before the meeting at 703-228-3130 (TTY 703-228-4611), but can also see the Clerk the morning of the meeting. Interpretation services are also available for recessed meetings if requested at least one day in advance by calling the above number.

Internet viewers will have the option of seeing the webcast via a broadband or dial-up modem. A Windows Media player is necessary and a free player is available at the site. Public Comment Period: Held at Saturday Regular Meetings at 8:30 a.m. The purpose of this category is to alert the Board of items not on that day’s agenda, already decided, or scheduled for future hearings. Submit a speaker slip to the Clerk; you have up to 2 minutes to speak; only one speaker per topic will be heard.
 
Consent Agenda: Items removed on Saturday, no earlier than 9 a.m., will be heard at 6:30 p.m. on Tuesday. This will automatically remove the item from the Consent Agenda and carry it over to the following Tuesday Recessed Meeting for public testimony (no speakers will be heard on Saturday). Submit a speaker slip on Saturday, identifying all the Consent Agenda item number(s) you wish to address on one slip; at the Tuesday meeting, individuals and organizations have up to 3 minutes to speak on all matters. (Example: if you sign-up to speak on two items, you are called one time to speak a maximum of three minutes on both items.); speakers are heard in a group before the Board begins discussing the removed Consent Agenda items; additional speakers may sign-up to testify on the previously removed items at the Tuesday recessed meeting by submitting a speaker slip by 6:30 p.m.
 
Regular Hearing: Items heard no earlier than 9 a.m. on Saturday, and no earlier than 6:45 p.m. on Tuesday. Carefully check the agenda. Matters may be scheduled for hearing at the Saturday regular meeting or the prescheduled Tuesday recessed meeting. Submit a speaker slip to the Clerk before the first speaker on your item is called; no slips will be accepted after that time; individuals may speak for a maximum of 2 or 3 minutes per agenda item; representatives of civic organizations may speak for a maximum of 2, 3, or 5 minutes. (The 5 minute slot is reserved for civic organizations.); 2 minute speakers are called first; 3 minute speakers second; and, finally, 5 minute speakers. In each category, speakers will be called in the order in which slips are received.
 
Speaker slips may be downloaded in advance of the meeting. Visit the County Board homepage at www.arlingtonva.us and under “Local Government” under Topics, click “County Board Meetings”. You can complete the web form online but you must hand it to the Clerk in the Board Room the day of the hearing. No slips are accepted in advance of the meeting.
 
Written materials should be handed directly to the Clerk. Oral testimony should not duplicate written statements. When submitting materials, please provide 8 copies for the Board, staff, and the public record.
