Enactment of an ordinance to amend and reenact an ordinance to vacate on part of Parcel B-2A, Western Electric Company, Incorporated:  1) a portion of a 10’ utility easement for water main on the southwest portion of the parcel; and, 2) a 15’ storm sewer easement on the southwest portion of the parcel, known as 1201 S. Hayes Street and 1200 S. Fern Street, Arlington County, Virginia (RPC No. 35004001), with Conditions.



C.M. Recommendation:    Enact the ordinance (attached to the staff report) to amend and reenact an ordinance to vacate on part of Parcel B-2A, Western Electric Company, Incorporated:  1) a portion of a 10’ utility easement for water main on the southwest portion of the parcel; and, 2) a 15’ storm sewer easement on the southwest portion of the parcel, known as 1201 S. Hayes Street and 1200 S. C.M. Recommendation:    Approve the deed (attached to the staff report) releasing a restrictive covenant running solely to the benefit of the County on real property known as 1910 S. Nelson Street, Lot 34, Block B, Douglas Park (RPC #s 31015061), which covenant is contained in a deed recorded among the land records of the Circuit Court of Arlington County, Virginia, in Deed Book 2107 at page 1353.  And authorize the Real Estate Bureau Chief, or his designee, to execute on behalf of the County Board of Arlington County, Virginia, the deed releasing a restrictive covenant and all related documents, subject to approval as to form by the County Attorney.

16. Approval of a resolution granting a density credit, under Section 36.L. of The Arlington County Zoning Ordinance for a parcel, with multiple addresses located at the southeast corner of the intersection of North Glebe Road and 20th Road North, RPC No. 07008006, in exchange for a fee simple dedication for public street and utilities purposes of a portion of the aforesaid parcel to the County Board of Arlington County, Virginia; and approval and acceptance of an offer of a deed of dedications and easements.  .



C.M. Recommendation:    Adopt the resolution attached (to the staff report) as Exhibit A granting a density credit in the amount of 3,463 square feet of land area to a parcel of real property with multiple addresses located at the southeast intersection of North Glebe Road and 20th Road North, RPC No. 07008006 to the fee simple owner of the property, Archstone Parkland Gardens, LLC , in exchange for the voluntary fee simple dedication to the County Board of Arlington County, Virginia, of a 3,463 square foot portion of the property for public street and utilities purposes.  Approve and accept an offer of a deed of dedications and easements, attached (to the staff report) as Exhibit B, from the applicant to the County Board of Arlington County, Virginia, dedicating the following portions of the property to the County Board: 1) 3,463 square feet in fee simple for public street and utilities purposes with a density credit for the property; 2) 630 square feet in fee simple for public street and utilities purposes without a density credit; 3) 40 square feet in fee simple for public street and utilities purposes without a density credit; 4) a 3,828 square-foot easement for public sidewalk and utilities purposes; 5) a 3,182 square foot ingress-egress easement; 6) a 362 square-foot public water service easement; and 7) a 10-foot wide public water line easement.  In addition, Authorize the Real Estate Bureau Chief or his Designee, to accept on behalf of the County Board of Arlington County, Virginia, the Deed, subject to approval of the Deed as to form and acknowledgement of the density credit by the County Attorney.

Ordinances, Plans and Policies



17. ZOA-10-01/FBC-9.  Zoning Ordinance amendments to Sections 1, 16, 18, 19, 20 (and its Appendix A), 21, 25A, 26, 28, 32A, 33 and 34 to: 1) delete "automobile service station," "public garage" and "tire shop" and instead add a new definition for, and references to "vehicle service establishment," which use would include vehicle fueling sales, accessory retail sales and vehicle service and repair uses; 2) permit vehicle service and repair as provided for in the proposed "vehicle service establishment" definition, by use permit approval, in Section 19. "C-1" Local Commercial Districts, Section 20 (and its Appendix A) "CP-FBC" Columbia Pike Form Based Code Districts and Section 25A. "C-O-A" Commercial Office Building, Hotel and Apartment Districts; 3) create a new definition for and update references to "vehicle body shop" as a use that includes both repair uses and vehicle body work, painting and upholstering; and 4) update usage of automobile-related terms.



C.M. Recommendation:    Defer the proposed Zoning Ordinance Amendment (ZOA-2010-01/FBC-9) to amend, reenact, and recodify the Zoning Ordinance, Sections 1, 16, 18, 19, 20, 21, 25A, 26, 28, 32A, 33 and 34, to the April 12, 2010, Planning Commission and the April 24, 2010, County Board meetings.

18. Parking Regulations



A. Amendments to the County’s Motor Vehicle Code, Chapter 14.2, Article 1 of the Arlington County Code.



C.M. Recommendation:    Adopt the amendments (attached to the staff report) to the County’s Motor Vehicle Code, Chapter 14.2, Article 1 of the Arlington County Code concerning the use of emerging technologies for payment of parking meters.

B. Request to advertise for a public hearing on proposed amendments to the County’s Motor Vehicle Code, Chapter 14.2, Article 1 of the Arlington County Code.



C.M. Recommendation:    Authorize the request to advertise a public hearing to be held on March 25, 2010, to consider proposed amendments to the County’s Motor Vehicle Code, Chapter 14.2, Article 1 of the Arlington County Code to establish parking meter fees for tour buses and fines for parking inappropriately in tour bus zones.

Capital Projects



19. Funding request for Neighborhood Conservation (NC) Program projects.



C.M. Recommendation:    Approve the use of a total of $2,033,706 of Neighborhood Conservation bond funds for the priority neighborhood projects listed in Attachment A (of the staff report) as approved by the Neighborhood Conservation Advisory Committee for fall 2009, and authorize the County Manager to proceed with implementation of these projects.

20. Approval of an increase in the contract amount under Contract 445-07 between the County Board and Hughes Group Architects (HGA) for architectural and engineering services for the new Fire Station No. 3 located at 4100 Old Dominion Drive.



C.M. Recommendation:    Approve an increase of $60,000, plus a contingency of $15,000 for a total increase of $75,000, resulting in a total contract authorization of $970,932 to Contract 445-07 with HGA for additional architectural and engineering services needed to complete the design of new Fire Station No. 3.  In addition, authorize the Purchasing Agent to execute an amendment to the contract documents.

Approval of a license agreement between the County Board of Arlington County, Virginia and Washington Gas Light Company permitting two pressure regulator stations to be constructed, operated, and maintained on portions of the Arlington County Water Pollution Control Plant Site (RPC #37036002 and RPC #38006004).



C.M. Recommendation:    Approve the license agreement (attached to the staff report) between The County Board of Arlington County, Virginia and Washington Gas Light Company ("WGLCO") granting WGLCO a license to use portions of the Water Pollution Control Plant site (RPC #37036002 and RPC #38006004) for the construction, operation and maintenance of two pressure regulator stations for the purpose of supplying natural gas for the standby generator facility and other facilities at the WPCP.  And authorize the Real Estate Bureau Chief, Engineering and Capital Projects Division, Department of Environmental Services, or his designee, to execute, on behalf of the County Board, the license agreement, attached (to the staff report) as Attachment 1, subject to approval as to form by the County Attorney.

22. Acceptance and appropriation of an Office of Commonwealth Preparedness public safety 2009 Interoperability regional grant.



C.M. Recommendation:    Accept and appropriate $102,000 interoperability regional grant in FY 2010 from the Office of Commonwealth Preparedness to the Fire Department for the development of a regional public safety interoperability technical blueprint.

23. Request to Advertise a General Land Use Plan Amendment from "Service Commercial" (Personal and business services. Generally one to four stories. Maximum 1.5 F.A.R. with special provisions within the Columbia Pike Special Revitalization District.) to "Medium" Office-Apartment-Hotel (up to 2.5 F.A.R. Office Density, up to 115 units/acre Apartment Density, up to 180 units/acre Hotel Density) for a property known as 1900 Wilson Boulevard, generally located on the western part of the block in the area bounded by Wilson Boulevard, the proposed North Troy Street extension, Clarendon Boulevard, and North Rhodes Street.



C.M. Recommendation:    Adopt the resolution (attached to the staff report) to authorize advertisement for public hearings on the subject General Land Use Plan Amendment from "Service Commercial" to "Medium" Office-Apartment-Hotel, for dates concurrent with future public hearings by the Planning Commission and County Board for the associated site plan and rezoning applications.

24. Request to advertise public hearings to consider the local designation and historic district zoning overlay of the Washington/Torreyson Farm House, located at 1600 N. Lexington St. (RPC # 10-026-029).

Recommendation:    Adopt the resolution (attached to the staff report) to authorize the advertisement (Attachment A of the staff report) of public hearings by the Planning Commission on April 12, 2010, and the County Board on April 24, 2010, to consider adoption of an ordinance (see also Attachment A of the staff report) designating the Washington/Torreyson Farm House, located at 1600 N. Lexington St., as a local historic district and the creation of an historic district zoning overlay to consist of the legal property boundary.

26. ZOA-09-10A Zoning Ordinance amendment to Section 31A, Subsection E12. This amendment alters the standard for County Board review of appeals of Historical Affairs and Landmark Review Board (HALRB) decisions.



C.M. Recommendation:    Adopt the ordinance (attached to the staff report--ZOA-09-10A) to amend, reenact and recodify Section 31A of the Zoning Ordinance to change the standard by which the County Board would review appeals of decisions from the HALRB.

County Board meetings, usually conducted once a month on Saturday mornings with a corresponding recessed meeting on Tuesday evenings within a week or two of the initial regular meeting, are open to the public. For more information, or to obtain the meeting schedule, please call the County Board Office at 703-228-3130 (TTY 703-228-4611) on weekdays from 8 a.m. to 5 p.m.
 
Both Sign Language and Spanish Language interpreters are present for the first two hours of every regular Saturday Board meeting, from 8:30 a.m. to 10:30 a.m. Persons needing interpretation services are encouraged to call the Clerk at least 3 days before the meeting at 703-228-3130 (TTY 703-228-4611), but can also see the Clerk the morning of the meeting. Interpretation services are also available for recessed meetings if requested at least one day in advance by calling the above number.

Internet viewers will have the option of seeing the webcast via a broadband or dial-up modem. A Windows Media player is necessary and a free player is available at the site. INSTRUCTIONS FOR SPEAKING ON AGENDA ITEMS
 
 
The following are in accordance with the Meeting Procedures adopted by the County Board:
 
Public Comment Period: Held at Saturday Regular Meetings at 8:30 a.m. The purpose of this category is to alert the Board of items not on that day’s agenda, already decided, or scheduled for future hearings. Submit a speaker slip to the Clerk; you have up to 2 minutes to speak; only one speaker per topic will be heard.
 
Consent Agenda: Items removed on Saturday, no earlier than 9 a.m., will be heard at 6:30 p.m. on Tuesday. This will automatically remove the item from the Consent Agenda and carry it over to the following Tuesday Recessed Meeting for public testimony (no speakers will be heard on Saturday). Submit a speaker slip on Saturday, identifying all the Consent Agenda item number(s) you wish to address on one slip; at the Tuesday meeting, individuals and organizations have up to 3 minutes to speak on all matters. (Example: if you sign-up to speak on two items, you are called one time to speak a maximum of three minutes on both items.); speakers are heard in a group before the Board begins discussing the removed Consent Agenda items; additional speakers may sign-up to testify on the previously removed items at the Tuesday recessed meeting by submitting a speaker slip by 6:30 p.m.
 
Regular Hearing: Items heard no earlier than 9 a.m. on Saturday, and no earlier than 6:45 p.m. on Tuesday. Carefully check the agenda. Matters may be scheduled for hearing at the Saturday regular meeting or the prescheduled Tuesday recessed meeting. Submit a speaker slip to the Clerk before the first speaker on your item is called; no slips will be accepted after that time; individuals may speak for a maximum of 2 or 3 minutes per agenda item; representatives of civic organizations may speak for a maximum of 2, 3, or 5 minutes. (The 5 minute slot is reserved for civic organizations.); 2 minute speakers are called first; 3 minute speakers second; and, finally, 5 minute speakers. In each category, speakers will be called in the order in which slips are received.

You can complete the web form online but you must hand it to the Clerk in the Board Room the day of the hearing. No slips are accepted in advance of the meeting.
