Recommendation:   Enact the ordinance (attached to the staff report) to vacate  a portion of an easement for public sidewalk, utilities and storm drainage purposes on part of Lot 650, Ashton Heights (RPC# 19047010), with Conditions.  In addition, authorize the Real Estate Bureau Chief, or his designee, to execute the deed of vacation on behalf of the County Board, subject to approval of such deed as to form by the County Attorney.

16. Approval of a first amendment to lease agreement between the County Board of Arlington County, Virginia, as Landlord, and the Lucky Seven Food Mart Inc., as Tenant, for Real Property and Improvements known as 2406 Shirlington Road, Arlington, Virginia (RPC # 31035002).

Recommendation:   Approve the First Amendment to Lease Agreement (attached  to the staff report) by and between the County Board of Arlington County, Virginia, as Landlord, and the Lucky Seven Food Mart Inc., as Tenant, concerning the extension of the lease term for real property and improvements known as 2406 Shirlington Road, Arlington, Virginia (RPC # 31035002).  In addition, authorize the Real Estate Bureau Chief, Department of Environmental Services, or his designee, to execute, on behalf of the County Board, the First Amendment, subject to approval as to form by the County Attorney.

Approval of the appointment of substitute trustees under an Affordable Housing Investment Fund/ Home Program deed of trust naming Arlington County, Virginia, as Lender, and authorization of the County Manager and the substitute trustees to Subordinate the Affordable Housing Investment Fund/ Home Program deed of trust to a Deed Of Public Storm Sewer Easement To Be Conveyed to the County on Property known as 4439 North Pershing Drive, Arlington, Virginia (RPC # 20024239).



C.M. Recommendation:   Approve the appointment of substitute trustees for an Affordable Housing Investment Fund/Home Program (AHIF) Deed of Trust, subject to approval of the substitution document as to form by the County Attorney, on property now known as 4439 North Pershing Drive, Arlington, Virginia (RPC #20024239).  Authorize the County Manager, or his designee, to execute the document appointing Stephen A. Maclsaac and Ara Tramblian, as Substitute Trustees, either of whom may act, under the AHIF Deed of Trust, subject to approval as to form by the County Attorney. In addition, authorize the County Manager, or his designee, and the Substitute Trustees to execute the Deed of Easement to subordinate the lien of the AHIF Deed of Trust on the subject property to the Deed of Easement, subject to approval as to form by the County Attorney.

18. Approval of standard form license agreements for the use of space in the Artisphere, 1101 Wilson Boulevard, Arlington, Virginia (RPC #16039002).



C.M. Recommendation:   Approve the standard form Artisphere license agreement and the Artisphere use agreement (short form) [attached to the staff report] for use of space at the Artisphere.  Authorize the County Manager to execute, on behalf of the County Board, the approved license agreement, subject to approval as to form of each license agreement by the County Attorney.  Authorize the County Manager to approve a rate schedule for the use of the Artisphere space, equipment, and staff time, which schedule shall be attached to each license agreement and each use agreement.  Authorize the Executive Director of the Artisphere to execute, on behalf of the County Board, each use agreement, provided that it is: properly and fully completed; consistent with the County?s lease of 1101 Wilson Boulevard; and consistent with the approved rate schedule.  And, authorize the County Manager, upon prior written approval from the County?s landlord, 1101 Wilson Owner, LLC, to amend the portions of the license agreement concerning the provision of access to the licensed premises by the licensees, provided that such licensees comply with written conditions approved by the County Manager.

19. Adopt Amendment to Chapter 9.2 of the Arlington County Code (Food and Food Handling Code).



C.M. Recommendation:   Adopt ordinance amendments to Chapter 9.2 of the Arlington County Code to increase the annual licensure fee for permanent and mobile food establishment licenses from $100.00 to $285.00.

Capital Projects



21. Approval of the award of Contract No. 247-10 for the construction of Patrick Henry Drive Phases I and II improvements.



C.M. Recommendation:   Approve the award of the Contract No. 247-10 to Jeffrey Stack, Inc. for the construction of the Patrick Henry Drive Street Improvement Project, in the amount of $620,182.70, and authorize an allocation of $62,018.27 as a contingency for change orders and increased quantities.  The total project authorization is therefore $682,200.97.  In addition, authorize the Purchasing Agent to execute the contract documents for construction of the street improvements on Patrick Henry Drive, subject to review of such documents by the County Attorney.

22. Approval of second amendment to the phase two agreement between the Washington Metropolitan Area Transit Authority (WMATA) and the County Board of Arlington County, Virginia (County Board) for WMATA Construction Support of the Rosslyn Station Access Improvement Project (RSAIP).



C.M. Recommendation:   Approve the amendment to the phase two design agreement in the amount of $800,000 for the Rosslyn Station Access Improvement Project (Attachment 1) between WMATA and the County Board and authorize the County Manager to execute the Agreement subject to approval as to form by the County Attorney.

23. Approval of an agreement between the County Board and the Commonwealth of Virginia, Department of Transportation (VDOT) for the development, administration and construction of a new traffic signal at the intersection of North Glebe Road (State Route 120) & North Rock Spring Road.



C.M. Recommendation:   Approve the standard project administration agreement (Attachment 1 of the staff report) between the County Board of Arlington, Virginia and VDOT for the construction and administration of a new traffic signal at the intersection of North Glebe Road & North Rock Spring Road.  Also, authorize the County Manager or her designee to execute the agreement on behalf of the County Board, subject to approval of the agreement as to form by the County Attorney.

24. Approval of an amended Appendix A to a standard project administration agreement between the County Board and the Commonwealth of Virginia Department of Transportation (VDOT) for the Development and Administration of Rosslyn Circle Improvements and the North Lynn Street / Esplanade Project.



C.M. Recommendation:   Approve an Amended Appendix A to a Standard Project Administration Agreement between the County Board of Arlington, Virginia and the Commonwealth of Virginia, Department of Transportation (VDOT) dated November 13, 2008 for Rosslyn Circle / N. Lynn Street Esplanade Improvements and authorize the County Manager on behalf of the County Board to execute the Amended Appendix, subject to approval of the Amended Appendix as to form by the County Attorney.  Also, approve the reallocation of County received funds associated with JBG/Waterview Project (SP #25 DC #62) to fund the Construction Phase of a combined Rosslyn Circle Improvements, N. Lynn Street/Esplanade Project (Project).

25. Funding request for Neighborhood Conservation (NC) Program projects.



C.M. Recommendation:   Approve the use of a total of $3,873,611 of Neighborhood Conservation bond funds for the priority neighborhood projects listed in Attachment A (of the staff report) as approved by the Neighborhood Conservation Advisory Committee (NCAC) for Spring 2010, and authorize the County Manager to proceed with implementation of these projects.

26. Approval of an award of contract for the construction of Butler Holmes Park located at 101 S. Barton St., Invitation to Bid Number 229-10.



C.M. Recommendation:   Approve the Award of Contract Number 229-10 in the amount of $374,751.52 to Sumter Contracting Corp. and approve an allocation of $37,475.15 as a contingency for change orders for a total contract authorization of $412,226.67.  Authorize the Purchasing Agent to execute the contract documents and all other documents to implement the above actions, subject to review and approval of such documents by the County Attorney.

27. Budget Stabilization Funding to restore the Federal Medical Assistance Percentages (FMAP) reductions and housing grants shortfall.



C.M. Recommendation:   Authorize use of the Budget Stabilization Fund to restore state budget reductions stemming from the Federal Medical Assistance Percentages (FMAP) and to address housing grants shortfalls.  Allocate $457,615 from the Budget Stabilization Fund to the Department of Human Services to offset the FMAP revenue loss. In addition, allocate $406,000 from the Budget Stabilization Fund to the Department of Human Services to meet demand for Housing Grants.

28. Request to advertise public hearings on proposed a Zoning Ordinance amendment to Section 37.F, Violations and Penalties, Criminal Penalties, to make it unlawful for a firm, corporation, owner, agent or occupant to violate Section 37G, and also makes it unlawful for a firm, corporation, owner, agent or occupant to cause or, with knowledge, permit violations of Section 37.G.



C.M. Recommendation:   Adopt the resolution (attached to the staff report) to authorize advertisement of public hearings by the Planning Commission on November 29, 2010 and the County Board on December 11, 2010, on the attached ordinance to amend, reenact, and recodify the provisions in Sections 37.F, Violations and Penalties, Criminal Penalties, to make it unlawful for a firm, corporation, owner, agent or occupant to violate Section 37.G, and also to clarify that a firm, corporation, owner, agent or occupant causing or, with knowledge, permitting violations of Section 37.G, can be cited and held criminally liable for such violations.

INSTRUCTIONS FOR SPEAKING ON AGENDA ITEMS
 
 
The following are in accordance with the Meeting Procedures adopted by the County Board:
 
Public Comment Period: Held at Saturday Regular Meetings at 8:30 a.m. The purpose of this category is to alert the Board of items not on that day’s agenda, already decided, or scheduled for future hearings. Submit a speaker slip to the Clerk; you have up to 2 minutes to speak; only one speaker per topic will be heard.
 
Consent Agenda: Items removed on Saturday, no earlier than 9 a.m., will be heard at 6:30 p.m. on Tuesday. This will automatically remove the item from the Consent Agenda and carry it over to the following Tuesday Recessed Meeting for public testimony (no speakers will be heard on Saturday). Submit a speaker slip on Saturday, identifying all the Consent Agenda item number(s) you wish to address on one slip; at the Tuesday meeting, individuals and organizations have up to 3 minutes to speak on all matters. (Example: if you sign-up to speak on two items, you are called one time to speak a maximum of three minutes on both items.); speakers are heard in a group before the Board begins discussing the removed Consent Agenda items; additional speakers may sign-up to testify on the previously removed items at the Tuesday recessed meeting by submitting a speaker slip by 6:30 p.m.
 
Regular Hearing: Items heard no earlier than 9 a.m. on Saturday, and no earlier than 6:45 p.m. on Tuesday. Carefully check the agenda. Matters may be scheduled for hearing at the Saturday regular meeting or the prescheduled Tuesday recessed meeting. Submit a speaker slip to the Clerk before the first speaker on your item is called; no slips will be accepted after that time; individuals may speak for a maximum of 2 or 3 minutes per agenda item; representatives of civic organizations may speak for a maximum of 2, 3, or 5 minutes. (The 5 minute slot is reserved for civic organizations.); 2 minute speakers are called first; 3 minute speakers second; and, finally, 5 minute speakers. In each category, speakers will be called in the order in which slips are received.
 
Speaker slips may be downloaded in advance of the meeting. Visit the County Board homepage at www.arlingtonva.us and under “Local Government” under Topics, click “County Board Meetings”. You can complete the web form online but you must hand it to the Clerk in the Board Room the day of the hearing. No slips are accepted in advance of the meeting.
 
Written materials should be handed directly to the Clerk. Oral testimony should not duplicate written statements. When submitting materials, please provide 8 copies for the Board, staff, and the public record.
