1. SP #11 Site Plan Amendment to permit approximately 24,960 square feet of residential GFA to be used as office GFA with modifications to Zoning Ordinance requirements to include parking and other modifications as necessary to achieve the proposed development plan at Crystal Plaza 6; located at 2221 S. Clark Street (RPC# 34-020-003).



C.M. Recommendation:   Adopt the ordinance (attached to the staff report) to approve the subject site plan amendment to permit approximately 24,960 square feet of residential GFA to be used as office GFA with modifications to Zoning Ordinance requirements to include parking and other modifications as necessary to achieve the proposed development plan, subject to all previously approved conditions for the subject site and revised Conditions #2, 19, 27, 35, 37, 47, 61 and 62 of the ordinance.

Recommendation:   Adopt the ordinance (attached to the staff report) to approve a site plan amendment to permit construction of a roof deck at 1100 Wilson Blvd. with an option to construct the deck in two phases, with modification of use regulations for bonus height and density, subject to the conditions of the staff report.

Approve the deed of easement from Elena Ghyka to the County Board of Arlington County, Virginia (attached to the staff report as Attachment 2), granting to the County a permanent public storm sewer easement within a portion of the property located at 6105 26th St. N., RPC# 01-052-014. License Agreement between the County Board of Arlington County Virginia, as Licensor, and Arlington Food Assistance Center (AFAC), as Licensee, for: 1) non-exclusive permission for AFAC to place four shipping containers for food storage on property owned by the County known as 3806 S. Four Mile Run, RPC# 29-002-013; and 2) non-exclusive permission for AFAC to access the shipping containers from a portion of property owned by the County and known as 2654 South Oakland Street, RPC# 29-002-012 (License Agreement).



C.M. Recommendation:   Approve the License Agreement between the County Board of Arlington County Virginia, as Licensor, and Arlington Food Assistance Center (AFAC), as Licensee, for: 1) non-exclusive permission for AFAC to place four shipping containers for food storage on property owned by the County and known as 3806 S. Four Mile Run, RPC# 29-002-013; and 2) non-exclusive permission for AFAC to access the shipping containers from a portion of property owned by the County and known as 2654 South Oakland Street, RPC# 29-002-012, attached (to the staff report) as Attachment 1. Recommendation:   Approve the termination of a deed of lease dated February 5, 2015, between the County Board of Arlington County, Virginia, as landlord, and Alami Abderrahim, as tenant, for the retail space in the Arlington Mill Community Center. In addition, authorize the Real Estate Bureau Chief, Department of Environmental Services, or his designee, to execute, on behalf of the County Board, a Notice of Termination of Lease for the retail space in the Arlington Mill Community Center, subject to approval as to form by the County Attorney, and to cause the Notice of Termination to be given to Mr. Abderrahim.

21. Amendment of the Master Transportation Plan & Abandonment of a Portion of 32nd Street South as a Public Street



A. Amendment of the Master Transportation Plan to remove the portion of 32nd Street South running from the western boundary of Jefferson Davis Highway to the eastern boundary of South Eads Street; and



B. Abandonment, as a public street, of the portion of 32nd Street South running from the western boundary of Jefferson Davis Highway to the eastern boundary of South Eads Street.



P.C. Recommendation:   The Planning Commission recommendations are as follows: (1) The Planning Commission finds that the abandonment as a public street a portion of 32nd Street South running from the western boundary of Jefferson Davis Highway to the eastern boundary of South Eads Street is in conformance with the Comprehensive Plan. (2) The Planning Commission recommends that the County Board: (a) Adopt the resolution attached to the staff report dated April 16, 2015 to approve an amendment to the Master Transportation Plan ("MTP") in order to remove a portion of 32nd Street South from the MTP Map. (b) Enact the ordinance to abandon as a Public Street a portion of 32nd Street South running from the western boundary of Jefferson Davis Highway to the eastern boundary of South Eads Street. (c) Authorize the Real Estate Bureau Chief, Department of Environmental Services, to execute, on behalf of the County Board, all deeds and other documents necessary to effectuate the ordinance to abandon as a public street, subject to approval by the County Attorney.

22. Adopt an ordinance to amend Chapter 20-2 (Board of Equalization of Real Estate Assessments Established; Powers; Compensation) of the Code of Arlington County, Virginia (Code).



C.M. Recommendation:   Adopt an ordinance to amend Chapter 20-2 (Board of Equalization of Real Estate Assessments Established; Powers; Compensation of the Code of Arlington County, Virginia (Code) to reduce the number of members of the Board of Equalization of Real Estate Assessments from seven (7) to five (5) members.

A. Master Transportation Plan Amendment to remove a portion of 5th Place North, between North Pollard Street and North Quincy Street; and



B. Abandonment as a Public Street of a portion of 5th Place North between North Pollard Street and North Quincy Street (RPC#14-060-083).



C. GP-330-15-1 General Land Use Plan Amendment from Medium Residential (37-72 units/acre) to Public (Parks, schools, parkways, major unpaved rights-of-way, libraries and cultural facilities) for an area located in the block between North Quincy Street, Wilson Boulevard, North Pollard Street, and 5th Place North within Mosaic Park, approximately 0.85 acres; and identified as (RPC# 14060016, -017, -037, -042, part of 14060022 [now assigned RPC#14-060-083], and the right-of-way for 5th Place N.).



D. Certification of Transferable Development Rights by the Arlington County Board for the purpose of creating open space and developing community recreation and/or community facilities on an approximate 3,866 square foot former right-of way for 5th Place North located within Mosaic Park between North Pollard Street and North Quincy Street;



E. Z-2580-15-1 Rezoning from CM Limited Industrial Districts and RA8-18 Apartment Dwelling Districts to S-3A Special Districts located in the block between North Quincy Street, Wilson Boulevard, North Pollard Street and 5th Road North within Mosaic Park, of approximately 1.935 acres; and identified as RPC#14106016, -017, -019, -020, -037, -042, -060, and a portion of 14060022[now assigned RPC#14-060-083].



P.C. Recommendation:    The following are the recommendations of the Planning Commission: (1) The Planning Commission finds that the abandonment of 5th Place North is in compliance with the Comprehensive Plan. (2) The Planning Commission recommends that the County Board: (a) Adopt the attached Resolution to amend the Master Transportation Plan ("MTP") to remove a portion of 5th Place North from the MTP Map. (b) Enact the ordinance to abandon as a public street a portion of 5th Place North between North Pollard Street and North Quincy Street. (c) Authorize the Real Estate Bureau Chief, Department of Environmental Services, to execute, on behalf of the County Board, all deeds or other documents necessary to effectuate the ordinance to abandon as a public street, subject to approval of such documents as to form by the County Attorney. (d) GP-330-15-1 Adopt the attached Resolution to amend the General Land Use Plan to change from "Medium" Residential to "Public" for an area located in the block between North Quincy Street, Wilson Boulevard, North Pollard Street and 5th Place North within Mosaic Park. (e) Adopt the attached Resolution certifying 7,499 square feet as transferable development rights on County-owned property located within Mosaic Park on the GLUP ("Sending Site") for the purposes of creating open space and developing community recreation and/or community facilities. (f) Direct the County Manager to record, among the land records of the Clerk of the Circuit Court of Arlington County, a covenant for the subject property limiting future use of said property to public open space, recreation uses and public access, within 12 months from this date, May 16, 2015. (g) Adopt the attached Resolution to approve the rezoning of the subject properties from "CM" Limited Industrial Districts and "RA8-18" Apartment Dwelling Districts to "S-3A" Special Districts, located in the block between North Quincy Street, Wilson Boulevard, North Pollard Street and 5th Road North within Mosaic Park. (3) The Planning Commission recommends that the County Board direct the County Manager to address the condition of North Pollard Street and ensure that the portion of North Pollard Street abutting the park site provide for consistent treatment in future development north of the park site. (4) The Planning Commission recommends that the County Board direct staff to study issues surrounding the practice of TDR with emphasis on TDR’s created from public land with a recommendation be made to the County Board by December 31, 2016. Issues should include but not limited to establishment of a TDR bank, the banking of both public and private TDRs, as well as fiscal issues surrounding TDRs.



C.M. Recommendation:   Adopt the resolution (attached to the staff report) to amend the Master Transportation Plan (MTP) to remove a portion of 5th Place North from the MTP Map. (Attachment 1 of the staff report).  Enact the ordinance (attached to the staff report) to abandon as a public street a portion of 5th Place North between North Pollard Street and North Quincy Street. Capital Projects



24. Award of Contract No. 722-15 to W.M. Schlosser Company, Inc. for construction services for the Arlington Transit ("ART") Bus Facility and Streetscape Improvements at 3201 S. Eads Street and 3175 S. Eads Street.



C.M. Recommendation:   Approve the award of Contract No. 722-15 between the Arlington County Board and W.M. Schlosser Company, Inc. to provide construction services for the ART Bus Facility and Streetscape Improvements at 3201 S. Eads Street and 3175 S. Eads Street in the amount of $12,366,000.00 plus contingency of $1,854,900.00, for a total contract authorization of $14,220,900.00. In addition, authorize the Purchasing Agent to execute the Contract, subject to legal review by the County Attorney.

25. Increase to Contract 594-14 with MTFA Architecture, Inc. (MTFA) for design and construction administration services for Homeless Services Center at 2020 N. 14th St.



C.M. Recommendation:   Approve an increase of $116,842.00 to Contract 594-14 with MTFA for additional construction administration services needed to complete the construction of the Homeless Services Center, and authorize an additional allocation of $25,000.00 as a contingency, for a revised total contract authorization amount of $930,513.00. In addition, authorize the Purchasing Agent to execute the contract documents, subject to legal review by the County Attorney.

26. Addition of two projects, the Shirlington Road Bridge Rehabilitation Project and the North Glebe Road at 18th Street North Pedestrian Improvements, to the Programmatic Project Administration Agreement between the County Board of Arlington County, Virginia and the Commonwealth of Virginia, Department of Transportation (VDOT), approved by the Arlington County Board on July 19, 2014 (Agreement).



C.M. Recommendation:   Approve the addition of two projects, the design of the Shirlington Road Bridge Rehabilitation Project and sidewalk improvements on 18th Street North at Glebe Road, to the Programmatic Project Administration Agreement between the County Board of Arlington County, Virginia and VDOT, approved by the Arlington County Board on July 19, 2014. In addition, authorize the County Manager or her designee to execute all related documents necessary to include these projects in the Agreement, subject to approval of the documents as to form by the County Attorney.

27. Memorandum of Agreement (MOA) between Arlington County Department of Parks and Recreation (DPR) and the Glencarlyn Citizen’s Association (GCA) for the use of Carlin Hall.



C.M. Recommendation:   Authorize the County Manager or her designee to enter into an MOA with the Glencarlyn Citizen’s Association for their use of Carlin Hall for GCA meetings and association activities.

Request to authorize advertisement of an ordinance to amend, reenact and recodify Chapter 14.2 (Motor Vehicles and Traffic) of the Arlington County Code by: (a) Adding subsection 14.2-8.2 to Chapter 14.2, relating to fines for use of Transitway lanes, and (b) Adding subsection 14.2-95.2 to Chapter 14.2, relating to failure to pay public transit fare.



C.M. Recommendation:   Authorize advertisement of the ordinance (Attachment A of the staff report) to amend, reenact and recodify Chapter 14.2 (Motor Vehicles and Traffic) of the Arlington County Code by: (a) Adding subsection 14.2-8.2 to Chapter 14.2, relating to fines for use of Transitway lanes, and (b) Adding subsection 14.2-95.2 to Chapter 14.2, relating to failure to pay public transit fare. Both items were heard by the Transportation Commission at its April 30, 2015, meeting and will be heard by the County Board at its June 13, 2015, meeting. The Transportation Commission is expected to take a position on these proposed changes at their May 28, 2015, session.

Recommendation:   Advertise a public hearing on June 13, 2015, to consider an ordinance to amend Chapter 17 (Miscellaneous Offenses and Provisions) of the Code of Arlington County, Virginia, to amend Section 17-7 relating to persons appearing intoxicated or profanely cursing in any public place in the County and related fines.

30. Memorandum of Understanding (MOU) between the Washington Metropolitan Area Transit Authority (WMATA) and the County Board to fuel and clean Arlington Transit (ART) Compressed Natural Gas (CNG) powered passenger vehicles at the WMATA Four Mile Run (FMR) facility.

Recommendation:   Adopt the resolution (Attachment 1 of the staff report) authorizing the sale of General Obligation Public Improvement Bonds in an amount not to exceed $77.44 million for new projects, and General Obligation Refunding Bonds in an amount not to exceed $200 million. In addition, appropriate and allocate, upon receipt of funds, proceeds in an amount not to exceed $77.44 million as follows: $9,370,000 to the Street and Highway Bond Fund (314); $3,000,000 to the Community Conservation Bond Fund (316); $18,365,000  to the Government Facility Bond Fund (317); $5,705,000 to the Parks and Recreation Bond Fund (324); $8,000,000    to the Metro Bond Fund (333); $3,000,000 to the Utility Water Bond Fund (525); and $30,000,000  to the Schools Bond Fund (887).

The Arlington County Board generally meets once a month on Saturdays with a corresponding recessed meeting on Tuesday within a week of the initial regular meeting. The Board typically does not meet during the month of August. The meetings are open to the public. A Spanish Language interpreter is present for the regular Saturday Board meeting, from 8:30 to 10:30 a.m. Persons needing Spanish language interpretation services are encouraged to contact the County Board Clerk at least three days in advance of the meeting at 703 228-3130 (TTY 703-228-4611), or notify the Clerk the morning of the meeting. Interpretation services also are available for recessed meetings if requested no less than one day in advance by calling the above number. Persons needing a sign language interpreter, assisted listening devices, alternate format materials, or other accommodation for qualified individuals with disabilities as described in the American with Disabilities Act should contact the County Board Office at 703-228-3130 or email arlingtonboard@arlingtonva.us no less than three days in advance of the meeting. In addition, the County offers closed-captioning services for all County Board meetings

INSTRUCTIONS FOR SPEAKING ON AGENDA ITEMS
 
 
The following instructions are in accordance with the Meeting Procedures adopted by the County Board:
 
Public Comment Period: Held at Saturday Regular Meetings at 8:30 a.m.This is an opportunity for residents to alert the Board of topics not on that days agenda, already decided, or scheduled for future hearings. All persons wanting to speak must submit a speaker slip to the Clerk prior to speaking. Each speaker has up to two minutes to speak. The Board will hear only one speaker per topic.
 
Consent Agenda Items. To speak on a consent agenda item, a citizen must submit a speaker slip at the Saturday regular meeting prior to the consent item being called, identifying all the Consent Agenda item number(s) he or she wants to address on one slip. Submission of a speaker slip will result in the item (s) being removed from the Consent Agenda on Saturday to be heard by the Board at 6:30 p.m. at the following Tuesday Recessed Meeting for public testimony (no speakers will be heard on Saturday). Individuals and organizations have up to three minutes to speak on all matters at the Tuesday meeting, (Example: persons who sign-up to speak on two items, will be called one time to speak a maximum of three minutes on both items.). The Board will hear speakers in a group before discussing the removed Consent Agenda items. Additional speakers may sign-up to testify on the previously removed items at the Tuesday recessed meeting by submitting a speaker slip by 6:30 p.m.
 
Regular Hearing: Items (Heard no earlier than 9 a.m. on Saturday, and no earlier than 6:45 p.m. on Tuesday).Speakers intending to address Regular Agenda items first must check if the item is on the agenda for the Saturday or the Tuesday recessed meeting, then submit a speaker slip to the Clerk before the first speaker on the item is called; no slips will be accepted after that time. Individuals may speak for a maximum of two-to-three minutes per agenda item; civic or community organizations representatives may speak for a maximum of two, three, or five minutes. The Clerk will call the two minute speakers first; followed by the three minute speakers second; and, finally, the five minute speakers in the order in which their slips are received in each category.

Individuals may download speaker slips in advance of the meeting by visiting the County Board website, and completing the form online. However, speakers must hand the completed slip to the Clerk in the Board Room the day of the hearing. The Clerk will not accept speaker slips in advance of the meeting.

The Board will accept written materials, not repeating oral testimony. Residents must provide eight copies of the information for County Board members, staff and the public record, and give it directly to the Clerk.
