16. ZOA-2020-03. Amendments to 7.1.3 of the Arlington County Zoning Ordinance (ACZO) to permit the establishment of outdoor cafes as an accessory use to a restaurant in the R- C (Multiple-family Dwelling and Commercial District) zoning district.

C.M. Recommendation:   Adopt the ordinance (attached to the staff report) to amend, reenact, and recodify §7.1.3 of the Arlington County Zoning Ordinance (ACZO) to permit the establishment of outdoor cafes as an accessory use to a restaurant in the R-C zoning district as shown in Attachment 1 (of the staff report).




PC Recommendation: The Planning Commission recommends that the County Board amend §7.1.3 of the ACZO to allow outdoor cafes associated with a restaurant 1) on private property as a permitted use by right, and 2) on public right-of-way or on private property within an easement for public use by County Board use permit approval.

(3) Approve the project agreement between the County of Arlington and VDOT (Attachment B of the staff report), subject to approval of the documents as to form by the County Attorney. Acceptance and appropriation of Virginias Department of Housing & Community Development’s (DHCD) COVID Homelessness Emergency Response Program (CHERP) Homeless Management Information Systems grant funds through the Emergency Solutions Grant stimulus funding (ESG-CV), authorized by the Coronavirus Aid, Relief, and Economic Security (CARES) Act.

C.M. Recommendation:   (1) Authorize the County Manager or his designee to accept $134,036 from DHCD for CHERP funding, sourced from federal ESG-CV stimulus funding through the CARES Act for Homeless Management Information Systems (HMIS) reporting requirements. Further authorize the County Manager, or his designee, to execute associated grant agreements. (2) Appropriate $134,036 from DHCD's (101.364900) CHERP funding, sourced from federal ESG-CV stimulus funding through the CARES Act to the Department of Human Services (101.51101) for HMIS reporting requirements. In addition, (3) ratify execution of the CHERP-HMIS Grant Agreement, dated November 18, 2020 for the release of emergency CHERP funding, attached (to the staff report) as Attachment 1.

25. Reallocation of $32,000 in the Fiscal Year (FY) 2021 budget of Shirlington Employment and Education Center (SEEC) Grant Agreement for rental assistance for Arlington day laborers

C.M. Recommendation:   Approve the amendment of the SEEC grant agreement to reallocate $32,000 in personnel and other discretionary funding to rental assistance for day laborers. In addition, authorize the County Manager or his designee to execute amendment to the grant agreement.

26. Accept and appropriate grant funds from the Arlington Community Foundation (ACF) for the Grocery Card Pilot Program approved by the County Board on August 25, 2020.

Recommendation:   Authorize the County Manager or his designee to accept $27,500 from the ACF for the Grocery Card Pilot Program, and to execute associated grant agreements in a form approved by the County Attorney. Recommendation:   (1) Authorize the County Manager or his designee to accept $53,456 from VEC in WIOA WPSP grant funds, and to execute related grant documents in a form approved by the County Attorney.(2) Appropriate $53,456 in WIOA WPSP grant funds from VEC (101.371434) to DHS (101.51131) to provide Wagner-Peyser Service Provision funding to Arlington County and Alexandria City businesses during the COVID-19 national emergency. (3) Approve an amended Memorandum of Understanding between the Virginia Employment Commission and the Alexandria/Arlington Regional Workforce Council subject as to approval as to form by the County Attorney. C.M. Recommendation:   Amend the County's Green Building Incentive Policy for Site Plans (see Attachment 1) to evaluate special exception site plan requests for bonus density under Arlington County Zoning Ordinance (ACZO) §15.5.7.A.1.




PC Recommendation: The Planning Commission recommends the following: (1) The Planning Commission recommends that the County Board amend the County’s Green Building Incentive Policy for Site Plans (in Attachment 1 to the report dated November 9, 2020) to evaluate special exception site plan requests for bonus density under Arlington County Zoning Ordinance (ACZO) §15.5.7.A.1.; and to amend the Baseline Requirements of the County’s Green Building Incentive Policy for Site Plans (in Attachment 1 to the report dated November 9, 2020) to require the exterior wall envelope, and any associated openings, shall be constructed with bird friendly materials between 0.5 and 36 feet above grade. (2) The Planning Commission recommends that the County Board direct staff to study electric vehicle capacity requirements for buildings developed after the June 2023 update to the County’s Green Building Incentive Policy.(3) The Planning Commission recommends that the County Board direct staff to study building electrification and provide a clear path forward for building electrification for buildings developed after the June 2023 update to the County’s Green Building Incentive Policy. (4) The Planning Commission recommends that the County Board direct staff to specifically consider and report on Arlington county policy constraints such as density exclusions and height limitations that might inhibit progress on full electrification of buildings as staff considers further updates to the 2023 policy update.

PC Recommendation: The Planning Commission recommends the following:(1) The Planning Commission recommends that the County Board authorize advertisement of a public hearing to be held at the January 23, 2021, County Board meeting to consider adoption of: (a) An ordinance to repeal, reenact, and recodify Article VIII of Chapter 14.2 (Residential Permit Parking program) as shown in Attachments A and B (of the staff report): and (b)an ordinance to amend, reenact, and recodify Article I, Division 1, section 14.2-7 (Fines for Nonmoving Violations) to address fines for parking in violation of Article VIII of Chapter 14.2 as shown in Attachments A and C (of the staff report) and; the Planning Commission also recommends that the County Board include language within the Purpose and Intent to address areas outside parking demand to include public health and environment. (2) The Planning Commission recommends to the County Board that the proposed RPP permit and pass fees as proposed in the staff proposal may be increased as appropriate to cover all costs (up to $250) to administer the RPP program fully.

This item will be heard at the Tuesday, December 15, 2020, Recessed County Board Meeting. ----Interagency funding agreement between Arlington County Government (ACG) and Arlington County Public School (APS) for design and construction of Phase 1 of stormwater infrastructure at Walter Reed Elementary School.

C.M. Recommendation:   Authorize the County Manager to execute the attached funding agreement subject to legal review by the County Attorney. In addition, authorize the fund transfer of $1,544,250.94 to APS for design and construction of stormwater infrastructure at Reed Elementary School.

The Arlington County Board generally meets once a month on Saturdays with a corresponding recessed meeting on Tuesday within a week of the initial regular meeting. The Board typically does not meet during the month of August. The meetings are open to the public. For more information, or to obtain the meeting schedule, telephone the County Board Office at 703-228-3130 (TTY 703-228-4611) on weekdays from 8 a.m. to 5 p.m.
 
A Spanish Language interpreter is present for the regular Saturday Board meeting, from 8:30 to 10:30 a.m. Persons needing Spanish language interpretation services are encouraged to contact the County Board Clerk at least three days in advance of the meeting at 703 228-3130 (TTY 703-228-4611), or notify the Clerk the morning of the meeting. Interpretation services also are available for recessed meetings if requested no less than one day in advance by calling the above number. Persons needing a sign language interpreter, assisted listening devices, alternate format materials, or other accommodation for qualified individuals with disabilities as described in the American with Disabilities Act should contact the County Board Office at 703-228-3130 or email arlingtonboard@arlingtonva.us no less than three days in advance of the meeting. INSTRUCTIONS FOR SPEAKING ON AGENDA ITEMS
 
 
The following instructions are in accordance with the Meeting Procedures adopted by the County Board:
 
Public Comment Period: Held at Saturday Regular Meetings at 8:30 a.m.This is an opportunity for residents to alert the Board of topics not on that days agenda, already decided, or scheduled for future hearings. All persons wanting to speak must submit a speaker slip to the Clerk prior to speaking. Each speaker has up to two minutes to speak. The Board will hear only one speaker per topic.
 
Consent Agenda Items. To speak on a consent agenda item, listed under Public Hearing Items, a citizen must submit a speaker slip at the Saturday regular meeting prior to the consent item being called, identifying all the Consent Agenda item number(s) he or she wants to address on one slip. Submission of a speaker slip will result in the item (s) being removed from the Consent Agenda on Saturday to be heard by the Board at 6:30 p.m. at the following Tuesday Recessed Meeting for public testimony (no speakers will be heard on Saturday). Individuals and organizations have up to three minutes to speak on all matters at the Tuesday meeting, (Example: persons who sign-up to speak on two items, will be called one time to speak a maximum of three minutes on both items.). The Board will hear speakers in a group before discussing the removed Consent Agenda items. Additional speakers may sign-up to testify on the previously removed items at the Tuesday recessed meeting by submitting a speaker slip by 6:30 p.m. Only County Board members may request removal of Non-Public Hearing Items. These items will also be discussed by the County Board at the Tuesday recessed meeting at 6:30 p.m.
 
Regular Hearing: Items (Heard no earlier than 9 a.m. on Saturday, and no earlier than 6:45 p.m. on Tuesday).Speakers intending to address Regular Agenda items first must check if the item is on the agenda for the Saturday or the Tuesday recessed meeting, then submit a speaker slip to the Clerk before the first speaker on the item is called; no slips will be accepted after that time. Individuals may speak for a maximum of two-to-three minutes per agenda item; civic or community organizations representatives may speak for a maximum of two, three, or five minutes. The Clerk will call the two minute speakers first; followed by the three minute speakers second; and, finally, the five minute speakers in the order in which their slips are received in each category.

Individuals may download speaker slips in advance of the meeting by visiting the County Board website, and completing the form online. However, speakers must hand the completed slip to the Clerk in the Board Room the day of the hearing. The Clerk will not accept speaker slips in advance of the meeting.

The Board will accept written materials, not repeating oral testimony. Residents must provide eight copies of the information for County Board members, staff and the public record, and give it directly to the Clerk.
